The original By-Laws and Covenants for Marsh Harbour, a nonprofit corporation, were put in place by the developer when the neighborhood was established in 1997. Amendments to both were voted in by the HOA. Marsh Harbour adopted the Georgia Homeowner's Association Act, which is perpetual meaning the covenants will never expire.
As Homeowners (land/lot owners) in Marsh Harbour, you automatically became a member of the association and are bound to certain deed restrictions, covenants and conditions. They include the association's regulations, and require that every owner be a member of the association and abide by its rules. The point of the rules is to protect the community, and to maintain or improve property values.
The covenants are a Deed Restriction and are non-negotiable. If you feel that you where deceived or not adequately notified that you were purchasing a home in a covenant protected community, you should call the attorney that conducted your closing.
